A federal appeals court has ruled that the Massachusetts Bay Transportation Authority unfairly disallowed the posting of an AIDS awareness advertisement which showed a wrapped condom under the headline “One of these will make you 1/1,000th of an inch larger.” The transit authority argued they were protecting children passengers against obscenity, but the court rejected the argument, ruling not only was the AIDS ad not obscene, but also that the transit authority lost their moral grounds when they previously allowed movie ads showing a woman eating a hot dog with the words “Come here often?” printed over her crotch.
