The “aggressive” San Diego, Calif., law firm Milberg Weiss Bershad Hynes & Lerach LLP recently sued Nintendo of America, Wizards of the Coast, and 4Kids Entertainment, charging that their sales practice of enticing children to buy Pokémon game cards constituted an illegal gambling scheme and racketeering. After filing the suit in a blaze of media coverage, Milberg Weiss realized that defendant 4Kids was the firm’s own client. The firm has announced it will not only withdraw from the prosecution of the case, but will not defend 4Kids, either, since that could be a conflict of interest.
